This Law regulates public relations in the field of physical culture and sports, defines legal, organizational, economic and social bases of support and development of mass physical culture, amateur and professional sports.
Chapter 1. General provisions
Article 1. Basic Concepts
The following definitions apply in this Act:
1) authorized agency for physical culture and sport - a central executive body of the Republic of Kazakhstan, carrying out functions of public administration and coordination in the field of physical culture and sports;
2) physical culture - an integral part of the culture, the area of social activity, which is a collection of spiritual and material values that are created and used by society to the physical development of man, to strengthen their health, contributing to the harmonious development of personality;
3) sports - part of physical education, which is a specific form of competitive activity, the training of athletes to participating in competitions;
4) elite sport - sports that achieve high results, the establishment of records;
5) technical and applied sports - part of the physical culture, which requires special training of an athlete to compete with the use of technical means;
6) professional sports - a kind of sport - entrepreneurial activity, whose main objective is to obtain revenue through sports - entertainment and participate in them;
7) classification of sports - a system of sports titles, ranks and categories that define the level of skill in particular sports, as well as a qualification level of coaches, athletes, trainers, methodologists and referees;
8) physical education - a teaching process aimed at formation of healthy, physically and spiritually perfect, morally staunch younger generation, health promotion, improving performance, creative longevity and extension of human life;
9) system of physical culture and sports - a set of state and public organizations engaged in activities for physical education of the population and sports development;
10) amateur sports - a multilateral mass sports movement in the overall system of physical education of citizens, giving the opportunity to improve their sports skills and achieve the highest results in various sports;
11) physical training (physical training - sports) movement - a form of social movement that promotes increased levels of physical culture among the population, purposeful activities of state and public organizations and citizens on the development of physical culture and sports;
12) physical training - recreational, sports and sports - technical facilities - facilities that are intended for use by citizens to exercise and go in for sports, and sporting entertainment events;
13) means of physical education - physical exercises, health powers of nature and hygienic factors;
14) sports industry - a set of business entities engaged in services and production of products for physical training - sports and tourist purposes;
15) accreditation – a formal recognition by the authorized body of the entitlements of the republican public association in the field of physical culture and sports to be a member of relevant international organizations on behalf of the Republic of Kazakhstan;
16) sectoral system of incentives - a form of incentives for workers of Physical Culture and sports for their contribution to the industry;
17) mass sports - part of physical culture, which is a massive sports movement that promotes the development of physical culture among the population in order to involve them in exercise and to identify talented athletes in various sports;
18) National Sports - part of physical culture, historically rooted in the form of competitive activity and representing a unique physical exercises and folk games with original rules and ways of organizing physical activity;
19) international sports competitions - competitions in sports types among athletes (teams), attended by representatives of at least five states.
Article 2. The principles of the state policy in the field of physical culture and sports
The state policy in the field of physical culture and sports in Kazakhstan is carried out in order to ensure a healthy way of living of citizens, development of physical culture and sports, and in accordance with the principles of:
1) equity and accessibility of physical activity and sports for all citizens;
2) continuity and succession of physical education of different age groups;
3) voluntary physical training and sports;
4) health-focus of physical training - sporting events;
5) recognition of state, public and private forms of organization of physical culture and sports;
6) equal respect for mass physical training, amateur and professional sport;
7) prioritization of elite sport, upholding the honor of the Republic of Kazakhstan in international competitions;
8) government support and promotion of physical culture and sports, encouraging sponsorship, charity and philanthropy;
9) preservation of physical training - health, sport and sport - technical installations and other facilities for the training of citizens in physical culture and sports under a change of their ownership;
10) development of folk games and national sports;
11) development of the scientific basis to study problems of physical training - sport movement, elite sport and medical care of athletes;
12) development of technical and applied sports.
Article 3. Legislation of the Republic of Kazakhstan in the field of physical culture and sports
Legislation in the field of physical culture and sports is based on the Constitution of the Republic of Kazakhstan, the norms of international treaties ratified by the Republic of Kazakhstan, and consists of this Law, other legal acts of the Republic of Kazakhstan.
Where an international treaty ratified by the Republic of Kazakhstan establishes other rules than those in this Act, the rules of international treaty apply.
Article 4. State support for the development of physical culture and sports
1. The state regulates relations in the field of physical culture and sports through the formation of public policy, creating an appropriate financial, material - technical, human, scientific - methodical, medical, informational, normative - legal provision of the development of physical culture and sports, as well as recognition of the status of amateur physical training - sports movement in the Republic of Kazakhstan.
2. The State creates environment for increasing the number of children - youth sports schools of all kinds and types of sports and children's clubs in the place of residence of citizens, children and youth recreation camps, specialized groups and schools for the disabled, medical - physical fitness dispensaries strengthening their material and technical base.
3. The state supports the development of external relations of physical training - sports organizations, integration into the international sports organizations and institutions that promote the growth of physical training - sports movement in Kazakhstan.
4. The State creates favorable investment climate for domestic and foreign investors who invest their funds in the design and construction of sports facilities, enterprises producing goods and equipment for sporting purpose, high-quality products for athletes that comply with international standards.
Article 5. The State Program for development of physical culture and sports in the Republic of Kazakhstan
1. The State Program for development of physical culture and sports in Kazakhstan is developed by the Government and approved by the President of the Republic of Kazakhstan.
2. The state program provides measures to organize the strengthening of the healthy population, the requirements for training programs for physical education, system of program - evaluation standards and requirements for the physical development of the different groups, the main directions of development of elite sport, as well as basic principles of organizational, material - technical, human, information and legal support.
Article 6. The rights and obligations of citizens in the field of physical culture and sports
1. Citizens of the Republic of Kazakhstan shall have the right to:
- engage in public associations of physical training - athletics and sports orientation;
- engage in physical culture and sports, including those as a professional activity;
- participate in the management of physical culture and sports;
- use state, municipal and private sports facilities and services for free or for a fee.
2. Citizens of the Republic of Kazakhstan, involved in sports, are obliged to:
- promote healthy lifestyles;
- worthily represent physical training - sports organizations and government at local, national and international competitions;
- to study and follow the principles of hygiene.
3. Parents, guardians, trustees, or their equivalents are required to care for the physical development and health promotion of minor children in the family, to create the necessary conditions for physical culture and sports.

Article 8. Promotion of Physical Culture and Sports
1. The authorized agency for physical culture and sports, public associations of physical training-recreational and sports orientation, health care institutions in conjunction with the mass media shall promote knowledge and achievements in the field of physical culture and sports, principles of healthy lifestyle.
2. It is not permitted to promote the cult of cruelty and violence, humiliation of human dignity, the use of banned stimulants and drugs, alcoholic beverages and tobacco products in sports.
3. Broadcasting sports competitions and other sporting events via television and radio broadcasting, as well as recording, including the use of audiovisual equipment, film and still photography by journalists and other media representatives are carried out in accordance with the legislation of the Republic of Kazakhstan on the mass media.
Advertising goods and services during the sports competitions and other sporting events is carried out on a contractual basis between the organizers and their subjects of advertising in accordance with the laws of the Republic of Kazakhstan.
Chapter 2. The system of physical education
Article 9. Physical education in preschool institutions, general education schools and other educational institutions
1. Physical education of pre-school children, students of secondary and vocational schools, colleges, lyceums, students in higher education institutions will be implemented in the educational and extended day, during extracurricular time, and independently in accordance with the curriculum, comprehensive state programs for physical education and sanitary - hygienic requirements. Mandatory physical education classes are held: in the preschool institutions at least eight hours a week, in a secondary school for at least 3 - hours, in vocational - technical schools, colleges, lyceums and higher education institutions for at least 4 - hours a week throughout the training period.
Pupils and students with weakened health are engaged in specialized medical groups and groups of medical physical culture.
2. For physical exercises outside school hours sports clubs and after-school sports - recreational organizations are created, which include children and youth sports schools, children and youth fitness clubs, children and youth clubs in the community and other organizations whose activities are aimed at the physical education and athletic training of pre-school children, pupils, and students.
3. Creating the conditions necessary for physical education in preschool institutions, after-school sports and recreational organizations and educational institutions is entrusted to local executive bodies of the regions, cities and districts, as well as the founders.
Article 10. Physical Culture and Sports in labor collectives
1. Businesses and organizations, regardless of ownership form, must provide the means for the development of physical education to improve the health of workers and to create conditions for the enforcement of citizens' right to engage in physical culture and sports.
2. Creation of facilities, their use, financing and provision of experts for organizing individual and group physical activities for workers and their family members are defined by collective agreements and physical culture and sports development programs.
Article 11. Physical culture and sports in the community and in places of public recreation
1. Creating the conditions for physical culture and sports by place of residence of citizens and in places of public recreation is entrusted to local executive bodies of cities, districts, mayors of districts in the city, cities of regional subordinance, aul (rural) districts, villages, rural settlements and bodies of local self-governments that provide assistance to physical-sports organizations in allocation of the necessary premises, places for exercising in the parks of culture and leisure and provision of sports facilities.
2. In the sanatorium-resort organizations, boarding houses, rest houses, tourist camps and in the suburban children's recreational camps conditions for the individual, group and family physical recreational activities are created.
Article 12. Physical education and sports for persons with disabilities
1. Physical culture and sports are the means of physical and social rehabilitation of persons with disabilities.
2. Local executive bodies shall ensure the creation of special sports-recreational and sports facilities, as well as creation of the environment for physical training and sports activities on public facilities for persons with disabilities.
3. Organization of physical culture and sports activities in the system of continuous rehabilitation of persons with mental and physical disabilities, training of personnel, procedural guidelines, health care and medical support for the physical training and sports activities of persons with disabilities are entrusted to the education, health care, social welfare, physical culture and sports agencies.
4. The authorized agency for physical culture and sport in conjunction with physical-sports associations of the disabled shall arrange for national competitions, training and participation of national teams in kinds of sport for the disabled in international competitions.
Local executive bodies of states (cities of republican status, capitals) in conjunction with physical - sports associations of the disabled organize regional sports events (cities of republican status, capitals), as well as their training and participation in national competitions.
Article 13. Physical training of the military and personnel of law enforcement agencies
1. Physical training of the military and personnel of law enforcement agencies is of service and applied focus, and ensures the fulfillment of military duty, and official responsibilities.
2. The contents, forms and methods of organization of the physical training of the military and personnel of law enforcement agencies are defined in the established order by the relevant agencies of State administration.
3. Commanding officers and heads of military elements, as well as divisions of law enforcement agencies are obliged to create the necessary conditions for the physical improvement of the military and personnel of law enforcement agencies.
4. Members of national sports teams of the Republic of Kazakhstan called-up for the military service are sent to the units that have all the necessary conditions for improving their sports skills, they are given the opportunity to participate in international, national and other sporting events.
Article 14. Participation of government agencies and health care institutions in the development of physical culture and sports
State agencies and health care institutions within their jurisdiction:
- use physical education as a means of prevention and treatment of diseases;
- carry out medical supervision and dynamic monitoring of persons engaged in physical culture and sports;
- participate in medical provision for preparations of national teams of the Republic of Kazakhstan for the international sports competitions;
- grant persons engaged in physical culture and sports permit to participate in competitions;
- prepares and organizes the raising of qualification of specialists in the field of sports medicine and physical therapy;
- under the current provisions are actively involved in organizing physical - recreational and sports activities in preschool institutions and educational establishments;
- determine the level of physical development of the population;
- provide anti-doping control in specialized institutions certified by the International Olympic Committee.
Article 15. Compliance with safety regulations, protection of citizens' health during physical training and sports activities, sports competitions and sports -public events
1. Physical culture and sports employees in conducting physical training and sports activities ensure compliance with safety rules and regulations developed and approved by the authorized agency on physical culture and sports.
2. The administration of physical - recreational and sports facilities provide adequate technical equipage of training and competition venues in accordance with the safety and sanitary – hygienic rules and is responsible for the harm caused to the health of citizens in accordance with the legislation of the Republic of Kazakhstan.
3. Objects and facilities designed for physical culture and sports activities, sports competitions and sports -mass events must comply with sanitary - hygienic standards
4. Physical Culture and Sports employees shall be responsible for the harm caused to the health of citizens engaged in physical culture and sports, in accordance with the legislation of the Republic of Kazakhstan.
Article 15-1. Government agencies in the field of physical culture and sports
Government agencies operating in the field of physical culture and sports have the right to provide services not related to their core business, the fee for which is not compulsory and is determined in agreement with individuals and legal persons.
Chapter 3. Organization and development of sports
Article 16. Training of high-class sportsmen
1. Training of high-class sportsmen is conducted by the state, public and private specialized sports institutions, as well as citizens in accordance with the programs of sports, approved by the authorized agencies for physical culture and sports.
2. Training of sportsmen of the Republic of Kazakhstan can be done on a contractual basis. Contract for the sports activity is based on the labor legislation of the Republic of Kazakhstan.
Contract for the sporting activity must contain the rights and obligations of an athlete, his social - health insurance, the terms and conditions of the conclusion and cancellation of the contract. Contract for the sporting activity may also contain other conditions and obligations which are not contradicting the legislation of the Republic of Kazakhstan.
Article 17. Sports schools and boarding schools
1. Sports schools as institutions of supplementary education and boarding schools for children gifted in sports are created in accordance with the laws of the Republic of Kazakhstan.
2. The government creates conditions for strengthening existing and creating new material and technical basis of sports schools and boarding schools for children gifted in sports.
Article 18. National sports teams of the Republic of Kazakhstan
1. National Teams of the Republic of Kazakhstan are groups of athletes, coaches, scientists and other workers in athletic - sports and sports medicine organizations, they are part of the sports federations and are created in order to train for international competitions and participate in them under the State Flag of the Republic of Kazakhstan.
2. National Teams of the Republic of Kazakhstan are formed in the light of proposals from athletic - sports organizations by the relevant federations in various sports on a competitive basis. Athletes who have completed the norms established and announced in advance in compliance with the principles of sports are included in the main Youth (standby) national team of Kazakhstan. Members of the teams of the Republic of Kazakhstan who fail to meet the established norms, systematically violating their duties, may be expelled from the national teams of the Republic of Kazakhstan. The compositions of the national teams of the Republic of Kazakhstan are approved annually by the authorized agency for physical culture and sports to represent federations on various sports.
Article 19. The right to engage in professional sports
1. The citizens of the Republic of Kazakhstan have the right to engage in paid professional sports activities in the Republic of Kazakhstan and other countries on a contract basis.
2. Procedures for establishing and operating conditions of professional associations, organizing employment in professional sports and contracting are determined by legislation of the Republic of Kazakhstan.
3. Professional activities of athletes, judges, coaches and other professionals associated with the preparation and participation in sporting competitions, which are the source of their income, are governed by the legislation of the Republic of Kazakhstan.
Article 20. Scientific and methodical support of sports activities
As part of the state programs for development of physical culture and sports the Government of Kazakhstan together with the concerned organizations carries out research on issues of physical culture and sports, develops scientific and methodical recommendations and programs aimed at the development of mass sports among different strata of the people and the achievement of higher athletic performance, draws leading scientists on a contract basis in the field of physical culture and sports, medicine, biology and psychology to the scientific and methodological support of teams of national teams of the Republic of Kazakhstan.
Article 21. Preparation of the sports reserve
In order to prepare a sports reserve a system of specialized training - sports facilities for children and youth are created. It includes children - youth sports schools, sports schools of Olympic reserve, boarding schools for children gifted in sports, schools of higher sports skills, training centers of Olympic reserve, and Olympic training centers.
Children's sports schools are out-of-school organizations engaged in supplementary education based on special programs and are created by the labor unions, voluntary sports societies, federations, sports clubs, individuals, organizing their activities in accordance with the law.
Article 22. Techniques, methods and the means that are prohibited in sports
1. In order to achieve sports results athletes, coaches and sports referees are disallowed:
- to apply the techniques, methods, medical and biological agents that are prohibited by the International Olympic Committee, international and national sports federations;
- to use bribery, blackmail, threats and violence in any form.
Article 22-1. Classification in Sports
1. Sporting titles and ranks are assigned to athletes in accordance with the qualification requirements established for a four (Olympic) cycle by the authorized agency for physical culture and sports.
Categories of coaches, trainers, methodologists, judges are assigned in accordance with the qualification requirements established by the authorized agency for physical culture and sports.
2. Athletes and coaches are given the following sports titles and ranks:
1) sports titles:
the honorary title "Honored coach of the Republic of Kazakhstan";
the honorary title "Merited Master of Sports of the Republic of Kazakhstan";
Master of Sports of the Republic of Kazakhstan of the international class;
Master of Sports of the Republic of Kazakhstan;
2) sports ranks:
Candidate for Master of Sports of the Republic of Kazakhstan;
An athlete of the 1 rank;
An athlete of the 2 rank;
An athlete of the 3 rank;
An athlete of the 1 youth rank;
An athlete of the 2 youth rank;
An athlete of the 3 youth rank.
3. Methodologists and instructors in physical culture and sports are assigned the following qualification categories:
- a methodologist of higher skill level of the highest category;
- a methodologist of higher skill level of the first category;
- a methodologist of higher skill level of the second category;
- a methodologist of higher skill level without a category;
- a methodologist of medium skill level of the highest category;
- a methodologist of medium skill level of the first category;
- a methodologist of medium skill level of the second category;
- a methodologist of medium skill level without a category;
- an instructor - athlete of higher skill level of the highest category;
- an instructor - athlete of higher skill level of the first category;
- an instructor - athlete of higher skill level of the second category.
4. Coaches in physical culture and sports are assigned the following qualification categories:
• a coach of higher skill level of the highest category;
• a coach of higher skill level of the first category;
• a coach of higher skill level of the second category;
• a coach of higher skill level without a category;
• a coach of medium skill level of the highest category;
• a coach of medium skill level of the first category;
• a coach of medium skill level of the second category;
• a coach of medium skill level without a category.
5. Judges in physical culture and sports are assigned the following qualification categories:
• a national sports judge of the highest category;
• a national sports judge;
• a sports judge of the first category;
• a sports judge.
Chapter 4. Management in the field of physical culture and sports
Article 23. The competence of the authorized agency for physical culture and sports
The authorized agency:
1) performs the functions of public administration, coordination, and state control in the field of physical culture and sports;
2) develops and approves within its jurisdiction the legal acts of the Republic of Kazakhstan on issues of physical culture and sports;
3) provides departmental statistical reports and receives statistical information from sports organizations;
4) develops and approves a sectoral system of incentives;
5) organizes training, retraining, advanced training of personnel in the field of physical culture and sports;
5-1) holds republican and international competitions in sports, including national, technical and applied forms, mass sports;
6) organizes and carries out training and participation of members of national teams of the Republic of Kazakhstan in international sports competitions;
7) organizes and coordinates scientific research in the field of physical culture and sports and the implementation of their results into the practice of physical culture and sports;
8) exercises control over the conduct of anti-doping measures in sport;
9) coordinates the project documentation for construction of sports facilities and provides methodical guidance in the production of sports equipment;
10) together with the authorized agency for standardization, metrology and certification participates in the certification and standardization in the field of physical culture and sports;
11) participates in the development and implementation of programs for physical culture and sports;
12) within its jurisdiction develops, executes and concludes international treaties in the field of physical culture and sports, represents Kazakhstan in international sports organizations and at international sporting events;
13) performs licensing of activities of national and regional public associations, unions and associations (federations), operating in physical culture and sports, individuals and legal entities providing physical- recreation, sports services on sports facilities of the highest category, as well as the accreditation of national public associations carrying out activities in physical education and sports;
14) assigns sports titles and categories: the honorary title "Honored coach of the Republic of Kazakhstan," the honorary title "Merited Master of Sports of the Republic of Kazakhstan," Master of Sports of the Republic of Kazakhstan of the international class, master of sports of the Republic of Kazakhstan, the coach of higher and middle skill level of the highest category, the instructor - athlete of higher skill level of the highest category and the methodologist of higher and middle skill level of the highest category, the national sports judge of the highest category, the national sports judge;
15) develops and approves regulations of physical fitness of the population;
16) develops regulations for provision of residential areas, administrative buildings, preschool institutions and educational institutions with sports facilities on the basis of the existing urban planning regulations;
17) develops and approves rules and regulations of use of sports facilities, norms of maintenance and operation of sports facilities;
18) together with the authorized agency for budget planning develops and approves regulations for material support and encouragement of participants in sports competitions and other sporting events;
19) determines the order of application of the state symbols of the Republic of Kazakhstan in sports competitions, grants permission to use the name "The team of the Republic of Kazakhstan" in the design of sports gear and other sporting goods;
20) governs the assignment of sports titles, ranks and categories.
Article 23-1. The jurisdiction of local executive bodies on issues in physical culture and sports
1. A regional (cities of republican status, capitals) executive body:
1) develops and implements regional programs of development of physical culture and sports;
2) holds regional (cities of republican status, capitals) competitions in various sports;
3) provides for the preparation of regional (cities of republican status, capitals) teams in various sports and their performance at national and international sporting events;
4) supports the development of mass sports and national sports on the corresponding territory of the administrative - territorial unit;
5) coordinates the activities of regional (cities of republican status, capitals) specialized training - sports facilities;
6) coordinates the issues concerning the construction of sports facilities in the region (cities of republican status, capitals);
7) provides methodical and advisory assistance to sports organizations;
8) assigns sports ranks and categories: Candidate for Master of Sports, the first sports rank, a coach of higher and middle skill level of the first category, an instructor - athlete of higher skill level of the first category, a methodologist of higher and middle skill level of the first category, a sports judge of the first category;
9) develops, approves and implements a schedule of regional public sports events;
10) coordinates the activities of sports organizations on the territory of the administrative - territorial unit;
11) coordinates the organization and carrying of sports events on the corresponding territory of the administrative - territorial unit;
12) analyzes and presents to the authorized agency for physical culture and sports the information, including statistical data, on the development of physical culture and sports in the respective administrative - territorial unit;
13) carries out the licensing of activities of sports and recreation, sports clubs, centers, sections, and other organizations engaged in physical, recreation and sports activities, legal entities and individuals providing physical and recreation, sports services in sports facilities of the first, second and third categories, local public associations, unions and associations (regional federations), operating on physical culture and sports.
2. A district (cities of oblast subordinance) executive body:
1) develops and implements district (cities of oblast subordinance) plans for the development of physical culture and sports;
2) holds competitions in sports at the district (cities of oblast subordinance ) level;
3) ensures the preparation of district (city of oblast subordinance) teams in various sports and their appearance at the regional sports competitions;
4) develops mass sports and national sports on the corresponding territory of the administrative - territorial unit;
5) coordinates the activities of district (cities of oblast subordinance) specialized training - sports facilities;
6) assigns sports ranks and categories: the second and the third ranks, the first, second and third youth ranks, a coach of higher and middle skill level of the second category, an instructor - athlete of higher skill level of the second category, a methodologist of higher and middle skill level of the second category, a sports judge;
7) develops, approves and implements the schedule of district public sports - events;
8) coordinates the activities of sports organizations in the corresponding territory of the administrative - territorial unit;
9) coordinates the organization and carrying of sports events on the corresponding territory of the administrative - territorial unit;
10) analyzes and presents to the regional (cities of republican status, capitals), executive body the information, including statistical data, on the development of physical culture and sports in the respective administrative - territorial unit.
3. Akim of a district in a city, a city of the district level, village, aul (village), aul (rural) district supports and assists in the material and technical provision of sports facilities on the corresponding territory of the administrative - territorial unit.
Article 24. Public associations in the field of physical culture and sports
1. Public associations in the field of physical culture and sports in the Republic of Kazakhstan are created and operate in accordance with this Law and the legislation of the Republic of Kazakhstan on public associations.
2. Not more than one national public association for each sport can be accredited to be a member of international associations on behalf of the Republic of Kazakhstan in the field of physical culture and sports.
The procedures and conditions for accreditation are determined by the Government of the Republic of Kazakhstan.
3. Public associations in the field of physical culture and sports organize and carry out sports competitions and other sporting events, including international events, in agreement with the authorized agency on physical culture and sports.
Article 24-1. Licensing of activities providing physical - recreational, sports services
1. Activities to provide physical - recreational, sports services by individuals and legal entities are subject to licensing, except for the activities in educational institutions.
2. Licensing procedures are approved by the Government of the Republic of Kazakhstan.
Article 24-2. The state supervision
1. The state supervision is executed by the authorized agency for physical culture and sports through inspections for compliance with standards, rules and regulations for the operation and maintenance of sports facilities.
3. Проверки субъектов малого предпринимательства проводятся не чаще одного раза в год.
2. The bases for the state supervision are the appeals of individuals and legal persons or other forms of official communications, with the exception of anonymous appeals, as well as activities aimed at the elimination of violations and enforcement of regulations issued by the officials of the authorized agency for physical culture and sports.
3. Audits of subjects of small business are held not more frequently than once a year.
Chapter 5. Financing, material, technical and personnel support of physical culture and sports
Article 25. Sources of funding of physical culture and sports
1. The State ensures the development of physical culture and sports in the Republic of Kazakhstan at the expense of budget funds and provides state support for the development of industry and physical culture and sports infrastructure.
2. Members of national teams of Kazakhstan during the preparation for international competitions, and while participating in them are provided with medical care and treatment.
3. The Government of the Republic of Kazakhstan approves norms of material support of sporting events and encouragement of national sporting events participants and members of the national teams of the Republic of Kazakhstan for the excellent results in international competitions.
Article 26. Sponsorship and entrepreneurial activity in the field of physical culture and sports
1. Sponsors of sports clubs, boarding schools, sports schools, teams or sporting events can be individuals or legal entities other than the organizations financed from the budget. The relationship between sponsors and sports clubs (boarding schools, sports schools, teams, event organizers) are mounted on a contractual basis. Sponsors, by financing sporting events, acquire the right to carry them out under the sponsor’s symbol (logo) or their products.
2. In accordance with the legislation of the Republic of Kazakhstan individuals and legal persons may engage in entrepreneurial activities in providing services to physical, sports organizations and individuals, produce athletic - sports and related goods, use physical culture and sports in promotional activities. Emblems and inscribed symbols of sports associations are their property and may be used only with the consent of these organizations.
3. The state encourages the development of physical culture and sports by expanding material - sports basis, as well as moral and material incentives for athletes, professionals of the industry and other entities of athletic - sports activities.
Article 27. Sports facilities
1. The material basis of physical culture and sports is formed of all kinds of athletic - recreational and sports facilities, which are the objects of social infrastructure.
Unique sports facilities are privatized under the decision of the Government of the Republic of Kazakhstan.
2. The territories reserved for sports facilities may be determined by the competent public authorities through regulatory diversion of land for current development and prospective reserve for future construction of these facilities.
The norms of provision of residential areas with sporting facilities are established in accordance with the legislation of the Republic of Kazakhstan.
3. It is not allowed to build housing estates, office buildings, preschool institutions and educational institutions with no sports facilities, stipulated by provision norms, building codes and regulations.
Article 28. Training of specialists in the field of physical culture and sports and professional requirements for physical and sports professionals
1. Instruction in physical education institutions and faculties of physical education is carried out in accordance with the laws of the Republic of Kazakhstan on education.
2. Persons with higher or post-secondary education are allowed to conduct teaching activities in physical culture and sports.
3. Professional requirements for employees in the field of physical culture and sports are governed by special qualification norms approved in the order established by legislation.
4. Judging of sports competitions and sports – events is allowed for persons specially trained in athletic - sports organizations and certified in established order as sports judges.
Chapter 6. Benefits and social guarantees in the field of physical culture and sports
Article 29. Preferential service in the field of physical culture
The list of categories of citizens who use sports - wellness services free of charge or on preferential terms, as well as the size of the benefits are established by the legislation of the Republic of Kazakhstan, the decisions of the district (cities of regional subordinance) executive body and administrations of organizations of athletic - recreation and sports orientation.
Article 30. Social security of athletes
1. The authorized agency for physical culture and sports, athletic - sports unions, local executive agencies may pay from the respective budgets, as well as other sources not prohibited by law, the monthly monetary maintenance to outstanding athletes - Olympic champions, world champions, having the title "Merited Master of Sports of the USSR", "Merited master of Sports of the Republic of Kazakhstan", "Master of Sports of the USSR of the international class", "Master of Sports of the Republic of Kazakhstan of the international class", who were or currently are forming part of national teams of the Republic of Kazakhstan in various sports, and their coaches who have the rank of "Honored coach of Kazakhstan" or "Honored coach of the USSR."
2. The authorized agency for physical culture and sports, athletic - sports unions, local executive agencies may pay from the respective budgets, as well as funds of organizations, regardless of ownership, and other sources not prohibited by law, the monthly monetary maintenance to athletes who form part of national teams of the Republic of Kazakhstan in various sports and to their coaches, and athletes, forming teams for sports games, their coaches and managers of club teams.
2-1. The authorized agency for physical culture and sports at the expense of budget funds pays compensation to members of national sports teams of the Republic of Kazakhstan when they receive traumas and permanent injuries during the national competitions.
3. An athlete has the right to transfer from one athletic - sports organization (sports club) to other athletic - sports organization (sports club) or a foreign athletic - sports organization (foreign sports club) after the expiration of the contract on the sport activity.
If an athlete’s move to another athletic - sports organization (sports club) occurs before the expiration of the contract for athletic activities or in case of failure to fulfill the obligations stipulated by the contract, moving of the athlete is possible only by mutual agreement of athletic - sports organizations (sports clubs).
The procedures and rules for athlete's move are established by the authorized agency for physical culture and sports.
Article 30-1. State social support of honored athletes and coaches
1. The state provides social support for athletes, coaches in the form of a monthly life-long financial support (hereinafter - the financial support), which is a monthly payment to athletes and coaches who are entitled to receive them, in accordance with this article.
2. Athletes and coaches, who formed part of the of national teams of the Republic of Kazakhstan and (or) national teams of the USSR in Olympic sports and who have the length of service of at least twenty years, are paid material support in the order established by the Government of the Republic of Kazakhstan, and it is assigned as follows:
1) athletes who became champions and (or) the prize winners of the Olympic Games and (or) World Champions in Olympic sports and having the title "Merited Master of Sports of the USSR" and (or) "Merited Master of Sports of the Republic of Kazakhstan" - 8.0 monthly calculation indices;
2) who have rank of "Honored coach of Kazakhstan" and (or) "Honored coach of the USSR" and prepared athletes set forth in subparagraph 1) of this paragraph - 8.0 monthly calculation indices.
4. Individuals who are eligible to receive financial support on several grounds set forth in paragraph 2 of this article receive material support only for one of the reasons of their choice.
Article 31. Insurance of athletes
Insurance of athletes against accidents during competition, training and meetings is carried out by means of the respective sports clubs, societies and other concerned organizations.
The authorized agency for physical culture and sports at the expense of budget funds carries out the insurance during training and participation of members of national sports teams of the Republic of Kazakhstan in official international competitions.
Chapter 7. International activities in the field of physical culture and sports
Article 32. International sporting activities
Sports organizations and athletes of the Republic of Kazakhstan shall have the right to participate in international sporting events held on the territory of the state and in other countries, in compliance with competition rules and the statute of the relevant international organizations.
Article 33. National Olympic Committee of the Republic of Kazakhstan
1. National Olympic Committee of the Republic of Kazakhstan:
- is a voluntary association established for the development the Olympic movement in the Republic of Kazakhstan, and operates in accordance with this Act, the legislation of the Republic of Kazakhstan on public associations and the Olympic Charter;
- represents the Republic of Kazakhstan in the International Olympic Committee;
- in collaboration with the authorized agency on physical culture and sports realizes an integrated policy for the development of high performance sport;
- in agreement with the authorized agency on physical culture and sports and in the interaction with the republican public associations of sports and local executive agencies coordinates the formation and provision of sports teams of the Republic of Kazakhstan to participate in the Olympics, Asian Games and other international sports events organized by the International Olympic Committee;
- implements the fulfillment of its statutory objectives in accordance with the State program for development of physical culture and sports with its own sources of funding;
- in accordance with the Olympic Charter carries out the measures to protect the property rights to use Olympic symbols, motto, flag, anthem, names "Olympic", "Olympics" of the International Olympic Committee in the Republic of Kazakhstan.
2. Performances of national sports teams of Kazakhstan at the Olympic, Asian Games and other international sporting events held under the patronage of the International Olympic Committee are carried out under the national flag of the Republic of Kazakhstan.
Article 34. Responsibility for the violation of legislation of the Republic of Kazakhstan on physical culture and sports
Individuals and legal entities guilty of violating the laws of the Republic of Kazakhstan on Physical Culture and Sports shall bear responsibility in accordance with the laws of the Republic of Kazakhstan.
This Law regulates public relations in the field of physical culture and sports, defines legal, organizational, economic and social bases of support and development of mass physical culture, amateur and professional sports.
